Acceptable Use Policy for T-Mobile Cell Lines

1. Introduction.

This Acceptable Use Policy (“AUP” or “Policy”) governs your use and access to a T-Mobile Cell Line provided by Bluecrew, its affiliates, or subsidiaries (collectively “Bluecrew” or the “Company”). Your acceptance of, and compliance with, this Acceptable Use Policy is a condition to your use of the Cell Line (as defined below). This Policy has been established to ensure that employees utilize the T-Mobile Cell Lines provided by the Company in a responsible, legal, and secure manner. This AUP sets forth guidelines, rules, and examples for the appropriate use of the Cell Lines.

By clicking “Accept,” you acknowledge that you have read in its entirety, understand, and fully accept all terms and conditions contained in these Acceptable Use Terms and our Privacy Policy. If you do not agree to be bound by these Acceptable Use Terms and our Privacy Policy, you are not authorized to access or use the Cell Lines and must PROMPTLY EXIT THIS APPLICATION.

2. Purpose.

The purpose of this Policy is to:  

a. Establish a clear understanding of the acceptable use of company-provided T-Mobile Cell Lines.  

b. Prevent the misuse of company resources and protect the Company from liability.  

c. Ensure that employees understand their responsibilities in using these Cell Lines.

3. Scope.

This Policy applies to all employees who have been provided a T-Mobile Cell Line for business purposes.

4. Definitions.

For the purposes of this policy, the following terms are defined as follows:

4.1 “Application” refers to the Bluecrew, EmployBridge, or other employment app, used by the User in relation to, or to facilitate, their work at the Company, such as by clocking in, clocking out, recording breaks, communicating with the Company, and other uses available within the Application.

4.2 “Cell Line” refers to the phone plan provided by Company.

4.3 "Personal Use" refers to any use of the device for non-work-related purposes.  

4.4 "Shift" refers to an individual work assignment completed through the Bluecrew app.  

4.5 "User" or “you” refers to any Company employee who has been provided a T-Mobile Cell Line.

5. Terms.

5.1. General Use. Users are permitted to use their Company-provided T-Mobile Cell Lines for both work-related purposes and Personal Use. However, Personal Use must not interfere with work responsibilities, cause any additional costs to the company, or violate any terms of this Policy.

5.2. Eligibility. To be eligible to use a Company-provided T-Mobile Cell Line, Users must work a minimum of 10 shifts per month through the Bluecrew app. Failure to meet this requirement may result in the cancellation of the User's phone line. Users will be granted a one-time, one-month grace period if they fail to work the required number of shifts.

5.3. Privacy Policies and Limited Monitoring. By using a company-provided T-Mobile Cell Line, Users agree to both the Bluecrew Privacy Policy (https://www.bluecrewjobs.com/privacy) and the California Employee Privacy Notice (https://www.bluecrewjobs.com/legal/california-employee-privacy-notice). Users acknowledge that they may be subject to limited monitoring. The Company may have access to the quantity of messages, data usage, and phone call metadata but will not have access to the content of any messages, calls, or data usage.

5.4. Phone Numbers. Users may bring their own cell phone numbers when they start using a company-provided T-Mobile Cell Line. If a User decides to stop using the T-Mobile Cell Line, the User may take their cell phone number with them.  

5.5. Prohibited Use. Users are strictly prohibited from using their T-Mobile Cell Lines for any illegal or negligent purposes. Examples of such activities include, but are not limited to:

a. Engaging in any form of harassment, bullying, discrimination or illegal activities, such as sending offensive, threatening, or defamatory messages or images.

b. Accessing, downloading, or sharing illegal, copyrighted, or explicit content, including movies, music, software, or adult material.

c. Engaging in any form of hacking, unauthorized access to computer systems, or unauthorized distribution of sensitive information.

d. Conducting any form of illegal gambling or participating in any online games that violate applicable laws.

e. Using the Cell Line to create, distribute, or execute malicious software, such as viruses, worms, or trojan horses.

f. Transmitting or storing any material that infringes on others' intellectual property rights, including trademarks, copyrights, and trade secrets.

g. Using the Cell Line to engage in or support criminal activities, such as theft, fraud, drug trafficking, or buying drugs.

h. Texting, calling, or using the Cell Line in any manner while driving or engaging in other activities that may be unsafe, illegal, or result in harm to others.

i. Using the Cell Line to harass, intimidate, stalk, or threaten others, including coworkers, clients, or members of the public.

5.6. Privacy and Security. Users are responsible for maintaining the privacy and security of their T-Mobile Cell Lines. This includes:

a. Keeping the device secure and not leaving it unattended in public places.

b. Setting a strong, unique password or PIN and not sharing it with others.

c. Reporting any lost or stolen devices immediately to Company's IT department or management.

d. Installing and regularly updating security software, as required by Company's IT department.

e. Avoiding the use of public Wi-Fi networks for accessing sensitive company information and using a VPN when necessary.

5.7 Agreement to T-Mobile Privacy Policy. By using a T-Mobile Cell Line, Users agree to T-Mobile's Privacy Policy, which can be found at: https://www.t-mobile.com/privacy-center/privacy-notices/b2b-privacy-notice

5.8 Bring Your Own Device. Users will not be provided with a device to use with the Cell Line. To take advantage of this incentive, a User will need to buy or bring an unlocked device to use with the Cell Line. Users are responsible for providing their own cellular phone, the Company is not responsible for a User’s cellular phone’s compatibility with T-Mobile service. It is the User’s exclusive responsibility to obtain a cellular phone that is compatible with the T-Mobile Cell Lines.

5.9 Availability of Service. The Company shall have no responsibility for the availability of Cell Line service. The User agrees and understands that the Cell Line is provided by T-Mobile, and that the Company cannot control coverage areas or signal strength.

5.10 Use of the Company Application. You understand and agree that provision of a Cell Line is given primarily so that you may use the Application in connection with your employment by the Company. You further understand that you are expected to use the Application and the Cell Line to properly record your time (clock in and out), and do any other tasks assigned by the Company (such as mandatory training). Provision of this Cell Line is given in lieu of any Company obligation to pay for, reimburse, or provide other benefits as a result of your required use of the Application during the course of your employment.

6. Liability and Indemnity.

6.1 Limitation of Liability. THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES (INCLUDING DAMAGES FOR LOSS OF PROFITS, REVENUES, CUSTOMERS, OPPORTUNITIES, GOODWILL, USE, OR DATA), EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. FURTHER, THE COMPANY WILL NOT BE RESPONSIBLE FOR ANY COMPENSATION, REIMBURSEMENT, OR DAMAGES ARISING IN CONNECTION WITH (A) A USERS INABILITY TO ACCESS OR USE THE CELL LINE FOR ANY REASON, (B) THE COST TO PROCURE SUBSTITUTE SERVICE, OR (C) ANY UNAUTHORIZED ACCESS TO, ALTERATION OF, OR THE DELETION, DESTRUCTION, DAMAGE, LOSS OR FAILURE TO STORE ANY DATA. THE COMPANY’S LIABILITY WITH RESPECT TO ANY INCIDENT WILL NOT EXCEED FIVE HUNDRED DOLLARS.

6.2 Indemnification. You agree to indemnify and hold the Company harmless against any liability, loss, damages, costs, and expenses which the Company may incur, including, but not limited to, attorneys’ fees and costs, which the Company may be required to pay in connection with any violation of this Policy.

7. Terms Compliance.

Failure to comply with this Policy may result in disciplinary action, up to and including termination of employment, and potential legal consequences. Users are required to report any suspected violations of this policy to their supervisor or Company’s IT department.

By using a T-Mobile Cell Line, Users acknowledge that they have read, understand, and agree to abide by this Acceptable Use Policy.
